US executive order moves to challenge state AI laws under a national framework

Executive Order 14365 at a glance

Executive Order 14365 created a Justice Department task force to contest state AI laws and asked for a single federal standard.

What changed with Executive Order 14365

On December 11, 2025, the President signed "Ensuring a National Policy Framework for Artificial Intelligence." It directs the Attorney General to form an AI Litigation Task Force within 30 days to challenge state AI laws that conflict with federal policy, and asks Commerce to publish a list of burdensome state laws within 90 days.

The order also ties some federal broadband funds to state AI rules, asks the FCC to consider a federal AI reporting and disclosure standard, and asks the FTC to explain how its deception rules apply to AI. A proposed federal law would leave child-safety and state procurement rules to the states.

Why Executive Order 14365 matters for businesses

State AI laws have not disappeared, so businesses using AI in hiring, lending, or customer contact should keep following the state rules that apply to them while the legal fights play out.
