Colorado repeals and replaces its AI Act with a narrower decision-making law

SB26-189 at a glance

SB26-189, signed May 14, 2026, swaps the original Colorado AI Act for notice, explanation, and appeal rights around automated decisions.

What changed with SB26-189

Colorado's governor signed SB26-189 on May 14, 2026. It repeals and reenacts the consumer protections of the 2024 Colorado AI Act (SB24-205) as rules for automated decision-making technology used in consequential decisions such as jobs, housing, lending, insurance, and health care.

Deployers must notify consumers at the point of interaction and give a plain-language explanation within 30 days of an adverse decision. Consumers can request and correct their data and ask for human review. Developer documentation duties begin January 1, 2027, and the attorney general enforces the law, with a 60-day cure period before 2030 and no private right of action.

Why SB26-189 matters for businesses

Agencies building AI screening, scoring, or eligibility tools for clients that serve Colorado residents should plan for disclosure notices and a human-review path.
